Preamble	Préambule
Recognizing the importance of the human rights treaties in ensuring the independence and impartiality of the treaty body members, and stressing the common will of the Chairs at their twenty-fourth meeting, convened in Addis Ababa in June 2012, to clarify and reinforce the treaty body provisions in this regard,	Reconnaissant l’importance des instruments internationaux relatifs aux droits de l’homme pour ce qui est d’assurer l’indépendance et l’impartialité des membres des organes conventionnels et soulignant la volonté commune exprimée par les présidents à leur vingt-quatrième réunion, tenue à Addis-Abeba en juin 2012, de clarifier et de renforcer les dispositions prévues par les organes conventionnels à cet égard,
Recalling that the Secretary-General has affirmed that the United Nations human rights treaty body system is one of the greatest achievements in the history of the global struggle for human rights and that these bodies stand at the heart of the international human rights protection system,	Rappelant que le Secrétaire général a affirmé que le système d’organes des Nations Unies créés en vertu d’instruments relatifs aux droits de l’homme est l’un des acquis majeurs de l’histoire de la lutte mondiale pour les droits de l’homme et que ces organes sont au cœur du système international de protection des droits de l’homme,
Noting that the report of the United Nations High Commissioner for Human Rights on the strengthening of the United Nations human rights treaty body system (A/66/860), which is the outcome of extensive consultations with all stakeholders, underlined the powers of the treaty bodies to decide on their own working methods and rules of procedure and to guarantee their independence as defined in the respective treaties,	Notant que, dans son rapport sur le renforcement des organes créés en vertu d’instruments relatifs aux droits de l’homme (A/66/860), aboutissement de vastes consultations avec toutes les parties prenantes, la Haut-Commissaire des Nations Unies aux droits de l’homme a souligné que ces organes ont le pouvoir de décider en toute indépendance de leurs méthodes de travail et règles de procédure et de garantir leur indépendance, telle qu’elle est définie dans les différents instruments internationaux,
Noting with appreciation that the General Assembly has also recognized the important, valuable and unique role and contribution of each of the human rights treaty bodies to the promotion and protection of human rights and fundamental freedoms,	Notant avec satisfaction que l’Assemblée générale a également reconnu le rôle et l’apport importants, précieux et uniques de chacun des organes conventionnels en ce qui concerne la promotion et la protection des droits de l’homme et des libertés fondamentales,
Recalling the right and statutory competence of each treaty body to adopt its own rules of procedure,	Rappelant que chaque organe conventionnel a le droit et la compétence statutaire d’adopter ses règles de procédure,
The Chairs of the United Nations treaty bodies, at their twenty-fourth meeting, following their decision at the twenty-third meeting in 2011 and after consulting their respective committees, discussed and endorsed guidelines on the independence and impartiality of treaty body members (“the Addis Ababa guidelines”), which they strongly recommend for prompt adoption by the respective treaty bodies, inter alia through inclusion, in an appropriate manner, in their rules of procedure.	Les présidents des organes conventionnels des Nations Unies, donnant suite à la décision prise en 2011 à leur vingt-troisième réunion et après consultation de leur comités respectifs, ont considéré et approuvé, à leur vingt-quatrième réunion, les principes directeurs relatifs à l’indépendance et à l’impartialité des membres des organes créés en vertu d’instruments relatifs aux droits de l’homme (« Principes directeurs d’Addis-Abeba »), dont ils recommandent vivement l’adoption rapide par les différents organes conventionnels, notamment en les incorporant de manière appropriée dans leurs règles de procédure.
General principles	Principes généraux
The independence and impartiality of members of the human rights treaty bodies is essential for the performance of their duties and responsibilities and requires that they serve in their personal capacity.	L’indépendance et l’impartialité des membres des organes créés en vertu d’instruments relatifs aux droits de l’homme sont indispensables à l’exercice de leurs fonctions et responsabilités et requièrent qu’ils siègent à titre personnel.
Treaty body members shall not only be independent and impartial, but shall also be seen by a reasonable observer to be so.	Les membres de ces organes doivent non seulement être indépendants et impartiaux, mais aussi être considérés comme tels par un observateur raisonnable.
Real or perceived conflicts of interest and challenges to the requirements of independence and impartiality may be generated by many factors, such as a member’s nationality, place of residence, current and past employment, membership of or affiliation with an organization, or family and social relations. In addition, conflicts of interest may also arise in relation to the interest of a State of which a member is a national or resident.	En outre, il peut y avoir conflit d’intérêts du fait de l’intérêt que peut avoir un État dont le membre est ressortissant ou résident.
Consequently, a treaty body member shall not be considered to have a real or perceived conflict of interest as a consequence of his or her race, ethnicity, religion, gender, disability, colour, descent or any other basis for discrimination as defined in the core international human rights treaties. Treaty body members commit themselves to abide by the principles of independence and impartiality when making their solemn declaration under the relevant treaty.	Les membres des organes conventionnels prendront l’engagement de respecter les principes d’indépendance et d’impartialité lors de leur déclaration solennelle dans le cadre de l’instrument international concerné.
The principle of independence requires that members not be removable during their term of office, except to the extent that the treaty in question so provides.	Le principe d’indépendance requiert l’inamovibilité des membres pendant leur mandat, sauf disposition contraire de l’instrument international considéré.
They may not be subject to direction or influence of any kind, or to pressure from the State of their nationality or any other State or its agencies, and they shall neither seek nor accept instructions from anyone concerning the performance of their duties. Consequently, members are accountable only to their own conscience and the relevant treaty body and not to their State or any other State.	En conséquence, les membres ne doivent rendre compte qu’à leur propre conscience et à l’organe conventionnel concerné et non à leur État, ni tout autre État.
Considering that within each treaty body, members are nationals of only a limited number of States parties, it is important that the election of one of its nationals to a given treaty body shall not result in, or be thought to result in, more favourable treatment for the State or States, as the case may be, of which the member is a national. In this regard, members holding multiple nationalities shall inform, on their own initiative, the chairperson of the relevant treaty body and its secretariat accordingly. Members holding multiple nationalities shall not participate in the consideration of reports, individual complaints, or take part in visits or inquiries relating to any of the States of which she or he is a national.	Les membres possédant plusieurs nationalités ne participeront pas à l’examen des rapports ou plaintes individuelles, ni aux visites ou enquêtes relatives à aucun des États dont ils ont la nationalité.
All members shall avoid any action in relation to the work of their treaty body which might lead to or might be seen by a reasonable observer to lead to bias against States.	Les membres éviteront toute action touchant aux activités de leur organe conventionnel qui soit susceptible d’entraîner ou puisse être considérée par un observateur raisonnable comme entraînant un parti pris à l’égard de certains États.
In particular, members shall avoid any action which might give the impression that their own or any given State was receiving treatment which was more favourable or less favourable than that accorded to other States. Application of the general principles	Application des principes généraux

Participation in consideration of State party reports and other report-related procedures	Participation à l’examen des rapports des États parties et aux autres procédures liées aux rapports
A member shall not participate or influence in any way the consideration of a State party report by the treaty body, or by any of its subsidiary bodies, if he or she may be seen by a reasonable observer to have a conflict of interest with respect to that State party.	Aucun membre ne peut participer à l’examen d’un rapport d’un État partie par son organe conventionnel ou l’un quelconque des organes subsidiaires de celui-ci, ni l’influencer en aucune façon, s’il peut être considéré par un observateur raisonnable comme ayant un conflit d’intérêts par rapport à cet État partie.
The same principle shall apply to any other treaty body procedure, such as follow-up, early warning or urgent action, which is not specifically mentioned in these guidelines. In case of a real or perceived conflict of interest with respect to a State party, a member:	En cas de conflit d’intérêts réel ou perçu par rapport à un État partie, le membre ne pourra :
Shall not participate or influence in any way the preparation, course or outcome of dialogues, discussions or any other public meetings of the treaty body, but may be present as an observer;	Participer à la préparation, à la tenue ou aux résultats des concertations, discussions ou autres réunions publiques de l’organe conventionnel ou les influencer en aucune façon, mais il pourra être présent en qualité d’observateur;
Shall not be present during any non-public consultations, briefings or meetings with a single country focus of his or her treaty body with other entities or partners, such as United Nations entities, national human rights institutions and civil society organizations. However, the member may receive the relevant documentation;	Toutefois, le membre pourra recevoir la documentation pertinente;
Shall not be present during discussions, deliberations or any other non-public meetings of his or her treaty body, such as for the preparation, drafting, discussion and adoption of concluding observations or any other related treaty body documents.	Prendre part aux discussions, délibérations ou toutes autres réunions non publiques de son organe conventionnel, notamment pour l’élaboration, la rédaction, la discussion et l’adoption des observations finales ou de tout autre document connexe de l’organe conventionnel.
Participation in the consideration of communications	Participation à l’examen des communications
A member shall not participate in, be present during, or influence in any way the examination of a communication, either at the admissibility or the merits stage, if:	Aucun membre ne peut participer à l’examen d’une communication, être présent durant celui-ci ou l’influencer en aucune façon, que ce soit au stade de la recevabilité ou de l’examen au fond :
The member is a national of the State whose acts are impugned by the communication or has any personal or professional conflict of interest in the case, or if any other real or perceived conflict of interest is present;	S’il est ressortissant de l’État dont les actes sont mis en cause par la communication ou s’il a un conflit d’intérêts personnel ou professionnel dans l’affaire ou en cas de tout autre conflit d’intérêts réel ou perçu;
The member has participated in any capacity, other than as a member of his or her treaty body, in the making of any decision on the case covered by the communication.	S’il a participé à un titre quelconque, autrement qu’en qualité de membre de son organe conventionnel, à la prise de toute décision concernant l’affaire couverte par la communication.
Participation in country visits and inquiries	Participation à des visites et enquêtes dans les pays
A member shall not participate in the preparation or conduct of or follow-up to a country visit or inquiry or in the consideration of ensuing reports if any real or perceived conflict of interest is present.	Aucun membre ne peut, en cas de conflit d’intérêts réel ou perçu, participer à la préparation, à la conduite ou au suivi d’une visite ou enquête dans un pays, ni à l’examen des rapports qui en résultent.
Relationship with States	Relations avec les États
The independence and impartiality of treaty body members is compromised by the political nature of their affiliation with the executive branch of the State.	L’indépendance et l’impartialité des membres des organes conventionnels se trouvent compromises en cas d’affiliation politique avec l’exécutif d’un État.
Members of treaty bodies shall consequently avoid functions or activities which are, or are seen by a reasonable observer to be, incompatible with the obligations and responsibilities of independent experts under the relevant treaties.	Les membres des organes conventionnels éviteront par conséquent toutes fonctions ou activités qui sont incompatibles ou peuvent être considérées par un observateur raisonnable comme étant incompatibles avec les obligations et responsabilités d’un expert indépendant dans le cadre d’un instrument international donné.
When acting as a consultant or as counsel for any State in connection with the process of reporting to the treaty body on which they serve or in any other matter that might come up for consideration before his or her treaty body, treaty body members shall take all necessary measures to ensure that they do not have, and are not seen by a reasonable observer as having, a conflict of interest.	Lorsqu’ils agissent en qualité de consultants ou conseillers d’un État quelconque relativement à la procédure de présentation de rapports à l’organe conventionnel dans lequel ils exercent leurs fonctions ou à toute autre question susceptible d’être examinée par ledit organe, les membres prendront toutes les mesures nécessaires pour veiller à ne pas avoir de conflit d’intérêts ou à ne pas être considérés comme tel par un observateur raisonnable.
Other situations which might entail a situation of a possible conflict of interest	Autres situations susceptibles de donner lieu à un conflit d’intérêts
Individuals holding or assuming decision-making positions in any organization or entity which may give rise to a real or perceived conflict of interest with the responsibilities inherent in the mandate as a member of a treaty body shall, whenever so required, not undertake any functions or activities that may appear not to be readily reconcilable with the perception of independence and impartiality.	Les personnes occupant ou assumant dans toute organisation ou entité des postes de décision susceptibles de donner lieu à un conflit d’intérêts, réel ou perçu, avec les responsabilités inhérentes au mandat de membre d’un organe conventionnel devront, chaque fois que cela sera nécessaire, s’abstenir d’assumer toute fonction ou activité susceptible de paraître incompatible avec la notion d’indépendance et d’impartialité.
Such organizations or entities may include private corporations or entities, civil society organizations, academic institutions or State-related organizations.	Cette organisation ou entité peut être une entreprise ou entité privée, une organisation de la société civile, un établissement universitaire ou un organisme d’État.
Participation in other human rights activities	Participation à d’autres activités relatives
When treaty body members participate in other human rights activities of intergovernmental organizations, such as panels, training courses and seminars, they shall make it clear that the views they are expressing are their own and not those of the treaty body in question unless the members have been expressly mandated by the latter.	aux droits de l’homme En cas de participation à d’autres activités d’organisations intergouvernementales relatives aux droits de l’homme (groupes d’experts, cours de formation, séminaires, etc.), les membres d’organes conventionnels devront préciser sans ambigüité que les avis qu’ils expriment sont les leurs et non ceux de leur organe conventionnel, sauf s’ils ont été expressément mandatés par celui-ci.
The same applies to meetings organized by States, civil society organizations and national human rights institutions.	Il en va de même des réunions organisées par les États, organisations de la société civile et institutions nationales des droits de l’homme.
Accountability	Responsabilité
Observance of the above guidelines falls first and foremost within the individual responsibility of each treaty body member and his or her own conscience.	Le respect des principes directeurs qui précèdent relève avant tout de la responsabilité individuelle de chaque membre d’un organe conventionnel et de sa conscience.
If for any reason a member considers that he or she is facing a potential conflict of interest, he or she shall promptly inform the chairperson of the treaty body concerned.	Si, pour une raison quelconque, il estime se trouver face à un conflit d’intérêts potentiel, le membre doit en informer promptement le président de l’organe conventionnel concerné.
Furthermore, if and when necessary, it is the duty of the chairperson of the relevant treaty body to remind individual members of the content of these guidelines if the situation so requires.	En outre, il est du devoir du président de l’organe conventionnel concerné de rappeler, le cas échéant, aux différents membres la teneur des présents principes directeurs.
Ultimately, the relevant committee as a whole shall take any measures deemed necessary to safeguard the requirements of independence and impartiality of its members.
